What are the purposes of processing your personal data?

Contractual purpose

Personal data will be processed for the purpose of the correct execution of the contract and/or provision of the service requested by the User, that is, to offer a technological platform that allows the online purchase of products related to babies, children and parents.

The purposes of processing the personal data of the Users organizing the event have their legitimate basis in the execution of a contract.

Advertising purpose:

The data provided will be processed for the purpose of sending information and commercial prospecting of products or services that Hiperstork offers on the market by email, Internet, messages or telephone calls.

What is the legitimacy for the processing of your data?

The legal basis for the processing of your data is the execution of the contract and/or provision of the requested service.

User consent is the legitimate basis for processing the data for sending commercial information about our products when the user is not yet a customer.

Hiperstork's legitimate interest in sending commercial information to customers about products and services similar to those initially contracted and information to build customer loyalty and any other information that falls within the Customer's reasonable expectations.

How long will we retain your data?

The period during which personal data will be kept for the execution of a contractual relationship will generally be based on criteria of continuity in the commercial relationship with Hiperstork and at least for the period necessary to fulfill the purpose for which they were collected, as well as for the minimum legal period provided for in commercial regulations and for the period to determine possible responsibilities associated with said purpose and treatment.

The period during which they will be kept for the purpose of sending commercial information about our products and Hiperstork services will be based on criteria of continuity in the commercial relationship and as long as you have not revoked your consent.

What are your rights when you provide us with your data?

Any person has the right to obtain confirmation as to whether or not Hiperstork is processing personal data that concerns them, exercising the right of access to their personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. On certain occasions, interested parties may request that the processing of their data be limited, in which case we will only retain it for the exercise or defence of claims. In some cases and for reasons related to their particular situation, interested parties may object to the processing of their data. Hiperstork will stop processing the data, except for compelling legitimate reasons, or the exercise of defence of possible claims.

If you exercise the right to object to the sending of advertising, your data will be included in an advertising exclusion list that aims to reduce the advertising you receive. You can also object to us carrying out commercial segmentations with the information we have about you in order to send you more appropriate offers if applicable. Interested parties have the right to data portability. The interested party has the right to object to the processing of their data for direct marketing purposes and the right not to receive commercial communications by electronic means or equivalent means of communication, by sending an email to Hiperstork with the subject line “unsubscribe”. Likewise, the interested party has the right to withdraw the consent given at any time. We inform you of your right to file a complaint with the Control Authority, in Spain it is the Spanish Data Protection Agency, https://www.aepd.es when the exercise of rights has not been made effective.

Will your personal data be transferred?

Your personal data will not be transferred to third parties without your prior consent, except when the transfer is authorized by law and/or constitutes a legal obligation, or responds to the fulfillment of purposes directly related to the legitimate functions of the transferor and the transferee and the free and legitimate acceptance of a legal relationship that necessarily implies the communication of the data to a third party for its fulfillment, development and control and provided that it is limited to the purpose that justifies it. This transfer constitutes a contractual requirement and necessary for the execution of the contract. The recipients of the data will be the suppliers and the type of data transferred are strictly necessary for their identification, with the User consenting to said transfer in full.

The user accepts that all personal data will be transferred in full to Aplazame from the moment the user has initiated the contracting of the deferred payment service offered by the latter at the time of choosing the payment method. This acceptance extends to third parties that may need to access the files for the successful completion of the contract.

Your personal data may also be communicated when Hiperstork has been required by the competent bodies in the exercise of the powers legally attributed to them, including, but not limited to, judicial bodies, regulatory bodies, security forces and bodies, in order to respond to legal requirements, criminal investigation of possible illegal activity, protection against claims by third parties for violation of intellectual property rights, and third party security. The type of data transferred is the name and surname, email address.

Will International Data Transfers be Made?
